On July 10, 2015, the Federal Bureau of Investigation (FBI) initiated a full investigation based upon a referral received from the US Intelligence Community Inspector General (ICIG), submitted in accordance with Section 811(c) of the Intelligence Authorization Act of 1995 and dated July 6, 2015, regarding the potential unauthorized transmission and storage of classified information on the personal e-mail server of former Secretary of State Hillary Clinton (Clinton).

The FBI’s investigation focused on determining whether classified information was transmitted or stored on unclassified systems in violation of federal criminal statutes and whether classified information was compromised by unauthorized individuals, to include foreign governments or intelligence services, via cyber intrusion or other means.

In furtherance of its investigation, the FBI acquired computer equipment and mobile devices, to include equipment associated with two separate e-mail server systems used by Clinton, and forensically reviewed the items to recover relevant evidence.

Hillary Rodham Clinton served as U.S. Secretary of State from January 21, 2009 to February 1, 2013. The FBI conducted an investigation into allegations that classified information was improperly stored or transmitted on a personal e-mail server she used during her tenure.

In or around 2007, Justin Cooper, at the time an aide to former President William Jefferson Clinton (President Clinton), purchased an Apple OS X server (Apple Server) for the sole purpose of hosting e-mail services for President Clinton’s staff.1-2 Due to concern over ensuring e-mail reliability and a desire to segregate e-mail for President Clinton’s various postpresidencyendeavors. President Clinton’s aides decided to maintain physical control of the Apple Server in the Clinton residence in Chappaqua, New York (Chappaqua residence)

According to Cooper, in or around January 2009 the decision was made to move to another server because the Apple Server was antiquated and users were experiencing problems with e-mail delivery on their BlackBerry devices 22 24 At the recommendation of Huma Abedin, Clinton’s long-time aide and later Deputy Chief of Staff at State, in or around fall 2008, Cooper contacted Bryan Pagliano, who worked on Clinton’s 2008 presidential campaign as an information technology specialist, to build the new server system and to assist Cooper with the administration of the new server system.

Investigation determined Clinton had access to a number of State-authorized secure means of telephonic communication in her residences and in her office at State. At the start of Clinton’s tenure. State installed a SCIF and secure communications equipment in her residences in Washington. D C. (Whitehaven residence) and Chappaqua. According to Abedin, Cooper, and [REDACTED] there were personally-owned desktop computers in the SClFs in Whitehaven and Chappaqua. Conversely, Clinton stated to the FBI she did not have a computer of any kind in the SCIFs in her residences.246 According to Abedin and Clinton, Clinton did not use a computer, and she primarily used her BlackBerry or iPad for checking emails.

Investigation identified hundreds of e-mails sent by Abedin and other State staff to [REDACTED]presidentclinton.com e-mail address requesting him to print documents for Clinton. Some of these e-mails were determined to contain information classified at the CONFIDENTIAL level. [REDACTED] received a security clearance at the SECRET level on October 25, 2007 from the Department of Defense (DOD) Documentation retained by DOD and provided to the FBI did not indicate [REDACTED]security clearance was deactivated upon his retirement from the US Navy Reserves in September 2010

Investigation determined Sidney Blumenthal, a former political aide to President Clinton and an informal political advisor to Clinton during her tenure at State, had direct e-mail contact with Clinton during her tenure at State. FBI investigation identified at least 179 emails that Blumenthal sent to Clinton containing information in memorandum format. The State FOIA process identified 24 memos from Blumenthal that contained information currently classified as CONFIDENTIAL and one as SECRET both when sent and currently. The FBI interviewed Blumenthal on January 7, 2016. According to Blumenthal, the content of the memos, which addressed topics to include Benghazi and foreign political developments, was provided to him from a number of different sources to include former USIC employees and contacts, as well as contacts within foreign

On July 2, 2016, Hillary Rodham Clinton, date of birth [REDACTED] was interviewed by Federal Bureau of Investigation (FBI) Special Agents (SA) [REDACTED] and [REDACTED] at the J. Edgar Hoover Building located at 935 Pennsylvania Avenue NW, Washington, DC 20535. Present for the interview were Clinton’s attorneys David E. Kendall, Katherine M. Turner, Cheryl D. Mills, Heather Samuelson and [REDACTED]. Also present was FBI Section Chief Peter P. Strzok as well as David Laufman, [REDACTED] and [REDACTED] from the Department of Justice (DOJ). Prior to the interview, Kendall, Turner, [REDACTED] and Samuelson agreed to sign a non disclosure agreement in anticipation of viewing documents during the interview that were classified as part of a Special Access Program (SAP).

CLINTON could not recall when she first received her security clearance and if she carried it with her to State via reciprocity from her time in the Senate. CLINTON could not recall any briefing or training by State related to the retention of federal records or handling of classified information.

CLINTON was aware she was an Original Classification Authority (OCA) at State. CLINTON could not recall how often she used this authority or any training or guidance provided by State. CLINTON could not give an example of how classification of a document was determined. CLINTON staled there was a process at State before she arrived and she relied on the career foreign service professionals she worked with to appropriately handle and mark classified information.

CLINTON recalled being briefed on Special Access Program (SAP) information but could not recall any specific briefing on how to handle information associated with SAPs. CLINTON was certain she signed an agreement memorializing her access to SAP material, but she could not recall specific detail. CLINTON recalled all SAP related information was delivered to her by paper in her office, through courier at her residence, or through conversation in her office or in the Situation Room at the White Mouse. In general. CLINTON knew SAP information was of great importance and needed to be handled carefully.

CLINTON did not recall receiving any emails she thought should not be on an unclassified system. She relied on State officials to use their judgment when emailing her and could not recall anyone raising concerns with her regarding the sensitivity of the information she received at her email address. CLINTON had frequent m-person meetings with State personnel where classified information was communicated, including a daily 8:30 AM staff meeting and numerous other walk-in and Walk-out meetings during the day.

After reviewing a State communication dated June 28, 2011 with the subject line “Securing Personal E-mail Accounts,” CLINTON stated all cables of a certain policy nature went out under her name and she did not recall this specific cable. Additionally, CLINTON did not recall this cable correlating with BRYAN PAGLIANO upgrading the clintonemail.com server. CLINTON did not consider switching to a state.gov account at this time, but did recall reports of compromises to state.gov systems. CLINTON understood the email system used by her husband’s personal stuff had an excellent track record with respect to security and had never been breached.

After reviewing an email dated April 9. 2012, with subject line “Call to President Banda,” CLINTON stated she did not remember the email specifically. When asked what the parenthetical “C” meant before a paragraph within the captioned entail, CLINTON slated she did not know and could only speculate it was referencing paragraphs marked in alphabetical order. CLINTON could not say for sure if the parenthetical used for portion marking classified documents. CLINTON understood the top of the email is marked “Confidential” and asked the interviewing Agents if that was what “C” referenced. [Agent note: email was marked as classified at the Confidential level by the FBI based on a determination by the OCA] When asked of her knowledge regarding Top Secret, Secret, and Confidential classification levels of US government information. CLINTON responded that she did not pay attention to the “level” of classified information and took all classified information seriously, CLINTON was not concerned the displayed email contained classified information. CLINTON believed the email amounted to a “condolence call” and questioned the classification level.

On February 26. 2016, [REDACTED] DOB [REDACTED] was interviewed by the Federal Bureau of Investigation (FBI) Special Agent [REDACTED] and [REDACTED] at the FBI Washington Field Office, 601 4th Street NW, Washington DC. Present for the interview was [REDACTED] counsel, [REDACTED] Attorney at Law at [REDACTED] as well as [REDACTED] and [REDACTED] from the  Department of Justice (DOJ) Counterintelligence and Export Control Section. Prior to the interview, [REDACTED] agreed to sign a non­-disclosure agreement in anticipation of viewing classified documents during the interview. After being advised of the identities of the interviewing agents, and the purpose of the interview, provided the following information:

[REDACTED] became the US Department of State (DoS) [REDACTED] under [REDACTED]. He continued to serve as the [REDACTED] under [REDACTED] became the [REDACTED] under [REDACTED] before being name the [REDACTED]. As the [REDACTED] office was located in Washington DC but he traveled frequently and took trips to Afghanistan and Pakistan every four to six weeks.

[REDACTED] did not have frequent contact with the Secretary of State when [REDACTED]. This was because [REDACTED] handled all of the direct communications with the Secretary and her team himself. [REDACTED] described his role under [REDACTED] as being external facing. He further explained that he was responsible for coordinating with Congress and facilitating other international and economic engagements. [REDACTED] became more focused on Afghanistan matters when [REDACTED] became the [REDACTED] because [REDACTED] wanted to focus mainly on Pakistan. In this role, [REDACTED] had more regular contact with the Secretary and her team, which included traveling to the region with them.

[REDACTED] provided that he primarily interacted with the following individuals on the Secretary’s team: CHERYL MILLS for USAID and communications matters; JAKE SULLIVAN for police matters and to prepare for Deputy Committee or Principal Committee meetings; HUMA ABEDIN for logistics and [REDACTED] for communication matters. [REDACTED] notes that he has [REDACTED].

[REDACTED] communicated directly with SULLIVAN arid MILLS for anything that needed the Secretary’s attention. Examples include topics that involved international matters, topics that could potentially impact DoS equities, and topics involving private sector engagements. These exchanges could he either classified or unclassified depending on the specific content and were done via the appropriate telephone or email system.

[REDACTED] date of birth [REDACTED] was interviewed at the offices of PLATTE RIVER NETWORKS (PRN), 5700 Washington Street. Denver Colorado 80216, by Federal Bureau of Investigation (FBI) Special Agents (SA) [REDACTED] and [REDACTED]. Also present during the interview were [REDACTED] attorney U.S. Department of Justice and [REDACTED] attorney at [REDACTED]. After being advised of the identity of the interviewing agents, and the nature of the interview [REDACTED] provided the following information:

In mid-2013, [REDACTED] was selected to provide technical support on a contract PRN had acquired for the management of a new server used solely for email exchange for domains and accounts associated with BILL CLINTON, HILLARY CLINTON and their aides under the PRN account name CESC (CESC client). [REDACTED] knew the company InfoGrate to be the contact who initiated the PRN contract with the CESC client. [REDACTED] understood the CESC client was already using email domains hosted on a server out of their residence in Chappaqua, New York, and in order to effect the transition to the PRN managed new server [REDACTED] needed to understand the needs of the client and the configuration of the server being housed in Chappaqua. [REDACTED] was put in contact with BRYAN PAGLIANO, who [REDACTED] understood to be the administrator of the server in Chappaqua. Pagliano granted [REDACTED] remote administrator access to the server under the administrator user name [REDACTED] logged in to the server at Chappaqua.

On September 14, 2015, [REDACTED] Platte River Networks, date of birth [REDACTED] social security number [REDACTED] was interviewed by Federal Bureau of Investigation (FBI) Special Agent (SA) [REDACTED] and SA [REDACTED]. Also present for the interview was Department of Justice (DOJ) Attorney [REDACTED] and [REDACTED] attorney at the [REDACTED]After being advised of the identity of the interviewing agents and the nature of the interview, [REDACTED] provided the following:

As [REDACTED], [REDACTED] described his role at PRN as a general role with the client and not involved with the technical details. [REDACTED] main concern is the general direction of the business.

Platte River Networks (PRN) worked with an individual named [REDACTED] to identify business opportunities. In early 2013 [REDACTED] to brought them a client opportunity who she claimed once worked as a public official. After submitting a bid to do the work, PRN became aware the contract they were bidding on was for the management of an email server hosting domains associated with BILL CLINTON, HILLARY CLINTON and their aides. PRN won the bid for the contract and the account was under the name CESC.

On April 19, 2016, [REDACTED] date of birth (DOB) [REDACTED] and social security number (SSAN) [REDACTED] was interviewed by Federal Bureau of Investigation (FBI) Special Agents (SA) [REDACTED] and [REDACTED]at the law offices of [REDACTED] located at [REDACTED] Washington DC 20005. Also present for the interview were [REDACTED] attorneys [REDACTED] and [REDACTED]. After being advised of the identity of the interviewing Agents, and the nature of the interview, [REDACTED] provided the following information:

[REDACTED] is currently the [REDACTED] [REDACTED] met President WILLIAM CLINTON and HILLARY CLINTON when he became an [REDACTED] at the White House in the fall of [REDACTED]. After his [REDACTED] served in various positions in the CLINTON White House and continued to work for President CLINTON after his presidency.

In the years after President CLINTON left the White House, CLINTON’S staff managed certain details related to the information technology needs of CLINTON’S office. One of those needs required negotiating with an individual who owned several .com domains related to CLINTON’S name. [REDACTED] recalled these domains to be presidentclinton.com, clintonfoundation.com, and owjc.com. Ultimately, negotiations were successful and the domains were purchased from the individual.

In 2006 or 2007, JUSTIN COOPER obtained a private email server (Apple Server) for the office of President CLINTON. COOPER and [REDACTED] had several conversations about reliability issues related to the previous outsourced server and decided it would be best to have a server under their physical control at the CLINTON’S residence in New York. COOPER handled the procurement and all aspects of server management, to include the creation of new accounts or any requests to move email. [REDACTED]  believed [REDACTED] [REDACTED] and [REDACTED] initially had email accounts on the Apple Server. [REDACTED] recalled a conversation with HUMA ABEDIN and COOPER regarding the addition of HILLARY CLINTON to the Apple Server. [REDACTED] thought it was a bad idea, but the issue had been decided by that point in time. [REDACTED] believed the addition of HILLARY CLINTON to the Apple Server occurred while she was in t he Senate. CLINTON used BlackBerry devices obtained by COOPER to access her email. [REDACTED] was not involved in the decision to move to a new server (Exchange Server), but recalled it was located, as was the Apple’ Server, in the basement of the CLINTON’S New York residence.

COOPER notified [REDACTED] a few times each year about attempted intrusions of the system, but [REDACTED] could not recall any specific details. They shared a mutual concern [REDACTED] had too much private information about the CLINTONS and may have had access to some of their communications.

[REDACTED] had no knowledge regarding the following topics:

discussions to move to the Exchange Server
personnel involved in the decision to move to the Exchange Server
domains on the Apple Server or Exchange Server
users on the Exchange Server
disposition of the Apple Server or Exchange Server after decommissioning
classified information on Apple Server or Exchange Server
conversations concerning federal records as it related to the Apple Server or Exchange Server
backups of the Apple Server or Exchange Server
Sensitive Compartmented Information Facilities at the CLINTON’S New York or Washington,
DC residences [REDACTED] did recall Secure Telephone Units in New York and Washington, DC
Secure fax machines or secure computers at the New York or Washington, DC residences

On May 12, 2016  [REDACTED] was interviewed by Federal Bureau of Investigation (FBI) Special Agents [REDACTED] and [REDACTED] in room 374 at the Eisenhower Executive Office Building 1650 Pennsylvania Avenue NW. Washington, DC 20502. Also present was [REDACTED] counsel [REDACTED] attorney at [REDACTED] and Department of Justice attorney [REDACTED]. After being advised of the identities of the interviewing agents, and the purpose of the interview. [REDACTED] provided the following information:

[REDACTED] is currently employed as the [REDACTED] at the National Security Council. [REDACTED] has held a Top Secret/Sensitive Compartmented Information (TS/SCI)
clearance since 2003 when he was originally sponsored by the Central Intelligence Agency (CIA). [REDACTED] us not,, nor has he ever been, an Original Classification Authority (OCA). In early [REDACTED] began a fellowship at the Department of State (DOS) in the South Asia Bureau. After moving to the Iran desk for a few weeks in [REDACTED] began working as [REDACTED] for the Special Representative for Afghanistan and Pakistan (SRAP) While at SRAP office [REDACTED] worked for PAUL JONES, FRANK RIJGGIERO. MARC GROSSMAN and RICHARD HOLBROOKE. [REDACTED] remained working for the SRAP until [REDACTED] when he moved to [REDACTED] at DOS.

a Sensitive Investigative Matter (SIM)

FBIHQ, Counterespionage Section, is opening a full investigation based on specific articulated facts provided by an 811 referral from the Inspector General of the Intelligence Community {ICIG), dated July 6, 2015 regarding the potential compromise of classified information.

The purpose of this investigation is to detect, obtain information about, and protect against federal crimes or threats to the national security. The initiation of this Full Investigation is based, as per AGG-Dom II.B.3 and DIOG Section 7.5, on activity constituting a federal crime or a threat to the national security has or may have occurred, is or may be occurring, or will or may occur and the investigation may obtain information relating to the activity or the involvement or role of an individual, group, or organization in such activity.

The ICIG referral provided a sample unclassified e-mail than allegedly contains information at a classified and SCI level. According to the ICIG, this e-mail was part of a larger trove of other unclassified e-mails they were reviewing during their own investigation.

The following documentation was provided by the ICIG and will be kept in the 1A section of the case file.

Due to the extremely sensitive nature of this investigation and the damage its disclosure could cause, the case will be designated as a prohibited investigation in accordance with the Counterintelligence Division Policy Implementation Guide. Author requests Assistant Director concurrence to maintain the identified case as prohibited.

This investigation is also designated a Sensitive Investigative Matter (SIM) due to a connection to a current public official, political appointee or candidate as defined in Section of the DIOG

Additionally, an Assistant Director exemption for uploading to Sentinel is requested. Since the ICIG referral alleges classified SCI material may have been compromised, all investigative work will be conducted on SCION. As documents to the case file are added, a placeholder will be entered into Sentinel and a serial number assigned to the document. Electronic copies of the case serials will be stored on SCION. The physical case file documents will be stored in a locked file cabinet located in a currently certified SCIF.
